Simon Phillips -V- Loftarch Pty Ltd and Stanborough Wemyss Contracting Pty Ltd

Between 1994 and 2001 Simon Phillips was deceived by Graeme Phillips and Matthew Phillips into believing that he was a 25% shareholder of Stanborough Wemyss Contracting Pty Ltd (SWC).


During this period, Simon Phillips was deceived by Graeme Phillips and Matthew Phillips to sacrifice salary, annual leave and superannuation in return for company dividend payments.


Up until 5 January 2022, Simon Phillips was unaware that Graeme Phillips:

  • criminal record detailed how he had been convicted and found guilty of 12 counts of obtaining property by deception in 1988 for stealing taxi driver insurance premiums. He was unaware of the personal impact that these crimes had on taxi drivers. Simon Phillips was repeatedly lied to by Graeme Phillips about the reason for his jail term.

  • had misappropriated over $1,000,000 in insurance premiums to fund an exorbitant lifestyle and had defamed his own staff and contractors to cover up his crimes. Graeme Phillips had told lies to Simon Phillips repeatedly about the facts of ATI -V- GPRTI case.

  • had deceived (along with Matthew Phillips) Stanborough and Wemyss Smyth to steal their profits, as well as their identity, reputation and intellectual property in order to gain Government contracts as soon as Graeme Phillips disqualification from being a company director had lapsed. Simon Phillips was unaware of the services Stanborough and Wemyss Smyth were providing vulnerable LTUE jobseekers, that were no longer provided when Stanborough and Wemyss Smyth uncovered Graeme Phillips and Matthew Phillips deception.

Victims of Crime

In March 2001 after 7 years working with Graeme Phillips and Matthew Phillips on the basis he was a 25% shareholder, Simon Phillips was told by Graeme Phillips and Matthew Phillips he was an employee and owned nothing.


Graeme Phillips and Matthew Phillips then reneged on Simon Phillips dividend request, to the commensurate value that Graeme Phillips and Matthew Phillips had received.


Simon Phillips was told by Graeme Phillips and Matthew Phillips that he was "stupid", a "soft cock" and had "no understanding of business".


Simon Phillips left SWC in April 2001.


Simon Phillips had no savings, no superannuation, or assets.


Simon Phillips commenced working with Graeme Phillips and Matthew Phillips at Stanborough Wemyss & Associates (SWA) in March 1994, five months prior to the incorporation of Stanborough Wemyss Contracting Pty Ltd (SWC) on 8th August 1994.


Simon Phillips, David Wemyss Smyth and Ron Stanborough were each deceived by a convicted criminal and his son as part of a premeditated scheme to acquire business, property and assets.


Commerce Transcends All

Graeme Phillips, in June 2001, two months after reneging on his son Simon Phillips dividend request, defaming him to his mother, brothers and sister and telling him that he was "stupid", a "soft cock" and had "no understanding of business" purchased the land at 14 Woodland Way, Fingal (Moonah Links) for $365,000.


Over the next 18 months Graeme Phillips would spend in excess of $2,000,000 on the property.


Between 1994 and 2001 Simon Phillips registered SWC as a registered training organisation (4567), built the training system, built the marketing program, won client contracts and attained the trainees, growing the business income to circa $4,000,000.


Between April 2001 to November 2003, the two years following the deception, Simon Phillips received Commonwealth Employment Services (dole) benefits in order to survive. Whilst Graeme Phillips and Matthew Phillips accumulated wealth.

In August 1998 Matthew Phillips received a dividend to purchase 80 Paxton Street, Malvern East for $449,000.

Graeme Phillips and Matthew Phillips purchased Unit 6, 17 Waratah Street, Rushcutters Bay in September 2000 for $805,000, despite Simon Phillips request for his dividend payment.


In December 2006 Matthew Phillips purchased 28 Coppin Street, East Malvern for $3,025,000 and in February 2007 sold 80 Paxton Street, Malvern East for $1,220,000.


In October 2007 Graeme Phillips purchased Unit 318, 250 St Kilda Road, Southbank VIC 2006 (The Melburnian) for $1,850,000 and sold Unit 3, 423 Glenferrie Road, Malvern VIC 3144 for $1,005,000.

Graeme Phillips purchased many racehorses including Miss Darcy and Canary Islands, trained by Anthony Cummings, adorned properties with artwork and travelled extensively with monies he stole from Simon Phillips, David Wemyss Smyth and Ron Stanborough.
